General Terms and Conditions of Business
1. Scope of Validity
The following General Terms and Conditions of Business apply to all contracts concluded with Golfino AG (hereinafter referred to as Golfino) for the acquisition and delivery of goods ordered through Golfino Online Store. Deviating terms and conditions of the contractual partner are hereby expressly rejected. Any and all ancillary agreements must be confirmed in writing by Golfino in order to be valid.
2. Prices and Shipping Costs
All prices quoted in Golfino Online Store include value-added tax but do not include shipping costs. A shipping fee of EUR 4.50 is charged for all deliveries within Germany. The shipping fee for deliveries to countries within the European Union can be up to EUR 6.90 (with the exception of Cyprus; here a shipping fee of EUR 20.00 is charged).
Details of shipping costs for deliveries to countries outside the European Union can be obtained by contacting email@example.com. In the case of these shipments, the recipient may also need to pay import fees and tax as well as any additional costs that may arise in order to clear customs. These additional charges and costs are beyond the control of Golfino.
3. Order Process and Conclusion of Contract
Orders may only be placed by legal entities and adult natural persons whose place of business and/or place of residence is within the European Union. We generally only ship to addresses within the European Union. For shipping requests outside the European Union, please contact firstname.lastname@example.org.
Goods may only be purchased in standard household quantities.
After you have placed your order, you will be sent an order confirmation. This does not yet mean that we have accepted the contract. The contract is only accepted at the time the goods are delivered to you. If we are unable to carry out your order because the goods are not in stock, we will inform you as soon as possible.
4. Right of Withdrawal/Instructions on Withdrawal
If you are a consumer within the meaning of Section 13 German Civil Code (BGB), i.e. if you order an item or items through our Golfino Online Store for a purpose that cannot be assigned to your commercial or self-employed activity, the statutory right of withdrawal below applies to you:
5. Delivery Service/ Unavailable Goods
It is possible that certain goods will be unavailable from time to time. To ensure that you do not have to wait for all your goods to be shipped, we will send all of the goods in your order that are in stock. The remaining goods will be sent as soon as possible at no additional shipping charge. Within Germany, orders will be shipped around five (5) business days from the day on which you receive our order confirmation.
If we do not accept an order because an item you have ordered is, by way of exception, no longer available, we will inform you immediately. Any payments that you might have made will be refunded in this instance.
6. Retention of Title
The goods will remain our property until we have received payment in full.
We abide by the statutory warranty regulations in the case of faulty goods. If and to the extent that we provide a seller’s guarantee, the individual terms and conditions of the guarantee will be enclosed with the goods in question. Guarantee claims exist irrespective of your statutory warranty rights.

If we are unable to resolve any disputes between Us, You have the right to refer the dispute to the EU’s Online Dispute Resolution platform at: http://ec.europa.eu/consumers/odr/.
9. Forms of Payment
You can pay the amount due by credit card, PayPal or by electronic funds transfer (EFT).
9.1. Payment by Credit Card
We accept the following standard credit cards: euro Master Card, Visa and American Express. If paying by credit card, you will need to provide the card number, the card security code (CSC) and the card’s validity date. If paying by credit card, the invoice amount will be debited from your credit card account. The card security code (CSC) can be found on the back of your Visa or euro Master Card credit card. It comprises three (3) digits and follows the six-digit card number. New security standards sometimes require that you enter an additional PIN, which your bank sends you.
9.2. Payment by PayPal
PayPal is an online payment service run by PayPal (Europe) that makes payments in real time. To use PayPal, you will need to register with PayPal and also log your bank and credit card details. PayPal payments are then carried out using your e-mail address and a password. The amount is then debited from your PayPal account.
9.3. Payment by Electronic Funds Transfer (EFT)
After you have placed your order, you will be directed to Saferpay, our payment service provider. There, you will need to enter your name, account number and sort code, after which the amount will be debited automatically from your account.
All content found in Golfino Online Store, including all texts, graphics, photos, images, illustrations and sounds, are copyright protected. This equally applies to trademarks in favour of Golfino AG that are used in Golfino Online Store. The use of any such content and trademarks is only permitted subject to Golfino providing its prior written consent.
11. Applicable Laws
All contracts between the customer and Golfino, and all disputes resulting from or on the basis of such contracts, are governed by the laws of the Federal Republic of Germany to the exclusion of the United Nations Convention on Contracts for the International Sale of Goods (CISG). For contracts that cannot be attributed to the business or operational activities of the purchaser (sales contract involving consumers), this choice of law will only apply to the extent that the consumer’s binding consumer rights in force in the country in which the consumer has his/her permanent place of residence are not revoked.
12. Court of Jurisdiction
For contracts that cannot be attributed to the business or operational activities of Golfino’s contractual partner (contracts with consumers), the court of jurisdiction for all disputes arising from or in connection with a contract is determined in accordance with the applicable statutory regulations.
For all disputes arising from or in connection with a contract concluded with a business person, i.e. a person who, at the time of concluding a legal transaction, is exercising his/her commercial or self-employed business activity, jurisdiction rests exclusively with the court with jurisdiction over the registered office of Golfino AG.
