GOLFINO Competitions - General Terms and Conditions of Entry
Competition entry is subject to the following conditions of entry:
1. Competition organiser
The competitions are organised by International Leisure Brands (Deutschland) GmbH, Humboldtstraße 15, D-21509 Glinde, Germany
2. Eligibility to enter
2.1 Only persons who have completed their 18th year of life are eligible to enter.
2.2 It is a condition of online entry that entrants issue the following declaration of consent for GOLFINO to advertise by email: “I consent to being informed of the range of offers and promotions by International Leisure Brands (Deutschland) GmbH by email or by post. I can withdraw this consent at any time with future effect. This withdrawal should be sent to: International Leisure Brands (Deutschland) GmbH, Humboldtstraße 15, D-21509 Glinde, Germany or by email to firstname.lastname@example.org”.
2.3 Employees of GOLFINO and their family members are excluded from entry.
2.4 GOLFINO has the right to exclude entrants from the competition if they manipulate the entry process or the competitions, or attempt to do so, or are in breach of the conditions of entry. Further claims (in particular to damages) remain unaffected by this.
3. Competition procedure
3.1 Entry is possible by completing an entry form at www.golfino.com. The fully completed entry form can be sent online as a form. Entrants must register with their name, age, postal address, phone number and email address. The details must be complete and correct. All personal details will be handled by GOLFINO in conformity with the provisions on data privacy. The address, phone number and email address serve for handing over possible prizes. The winners will be shown on www.golfino.com with their first name, the first letter of their surname and their place of residence.
3.2 The winners will be determined by chance by drawing lots.
3.3 Winners will be notified either in writing or by phone. If GOLFINO is unable to contact the winner by phone, GOLFINO will leave a message on their voicemail insofar as this is technically possible. The winner will then have one week to accept the prize. If no voicemail message can be left or if the winner does not contact GOLFINO in good time, the winner’s entitlement to the prize shall expire and GOLFINO can draw lots for the prize once again.
3.4 The claim to being awarded a prize shall expire if the prize cannot be handed over within three months of the first notification of the prize and this is due to circumstances that lie within the sphere of the winner.
4. Claiming prizes
4.1 The article presented as a prize within the framework of the competition will not necessarily be identical with the article that has been won. There might, for example, be differences in terms of the colour and the exact model, although the article that has been won will essentially be equivalent in value.
4.2 If making use of a prize involves incidental costs or travel costs, these costs do not form part of the prize and must be borne by the winner.
4.3 The entitlement to a prize is not transferrable.
4.4 GOLFINO excludes any liability for damages incurred by a winner through the acceptance or use of his prize.
4.5 The winner shall have no entitlement to being paid the cash value of a prize; this applies in particular to prizes in the form of vouchers.
5. Use of personal data and right of withdrawal
5.1 The entrant’s personal details (name, address, email, phone number) will be collected and processed within the context of the competitions. Apart from Point 5.3, these details will exclusively be stored and used, and – insofar as is necessary – passed on to third parties for the purpose of organising and running the competition. Apart from Point 5.3, the data will only be stored for as long as is necessary for running the competition in accordance with these conditions of entry.
5.2 If an entrant does not agree with this use of his details within the context of the competition according to Point 5.1, he can withdraw his agreement to enter the competition at any time. The entrant will thus be excluded from the competition and his personal details will immediately be deleted or blocked.

5.3 In the case of online entry, the entrant has at the same time also issued his agreement to email advertising in accordance with Point 2.2. The entrant can withdraw his agreement to this use for advertising purposes at any time without this reducing his chances of winning. His personal details will immediately be deleted or blocked. This withdrawal should be sent to: International Leisure Brands (Deutschland) GmbH, Humboldtstraße 15, 21509 Glinde, Germany or by email to firstname.lastname@example.org.
6. Premature termination of the competition or modification
GOLFINO reserves the right to break off or terminate a competition due to unforeseen circumstances without advance notice if the prize draw cannot take place according to plan. This shall be the case, for example, in the event of software and/or hardware faults and/or for other technical and/or legal reasons which adversely affect the regular and proper running of the competition. GOLFINO is also entitled to retrospectively modify the competition and the conditions of entry in order to avoid breaking the competition off. If such incidents are caused by an entrant, GOLFINO shall be entitled to contractual and statutory claims (in particular to damages) against this entrant.
7. Liability by GOLFINO
Claims to compensation directed against GOLFINO are excluded. This does not include claims to compensation arising out of death, injury to body or health, or liability for other damage due to an intentional or grossly negligent breach of duties by GOLFINO, its legal representatives or assistants. The aforementioned restrictions also apply in favour of the legal representatives and assistants of GOLFINO if claims are asserted directly against them. The provisions of the Produkthaftungsgesetz (Product Liability Act) remain unaffected.
No recourse to the courts is permitted. Exclusively the laws of the Federal Republic of Germany apply.
