General terms and conditions
1. Scope
The following general terms and conditions shall apply to all contracts concluded with Golfino AG (hereinafter referred to as “Golfino”) governing the purchase and delivery of goods from the Golfino online store. We hereby expressly contradict any diverging regulations from contractual partners. All additional agreements must be confirmed by Golfino in writing before they can take effect.
2. Prices and shipping costs
The prices listed in the Golfino online store contain the statutory VAT, but not the shipping costs. A shipping fee of €4.50 shall be charged for all deliveries within Germany and countries in the European Union.
For information about shipping costs for deliveries to countries outside the European Union, please write to golfino-shop@golfino.com. For these shipments, the recipient may have to pay import duties and taxes, as well as additional costs for customs clearance. Golfino has no influence on this process.
3. Order process and conclusion of contract
Only individual persons of full age and legal entities with a home address or headquarters in the European Union are allowed to place orders. We generally only ship goods to delivery addresses within the European Union. For shipment requests outside the European Union, please write to golfino-shop@golfino.com.
Goods shall only be shipped in household quantities.
You shall receive an order confirmation after placing your online order. However, this shall not constitute a formal acceptance of the contract on our part. We shall accept the contract upon shipment of the goods to you. We shall inform you as soon as possible if we are unable to complete an order due to the requested goods not being in stock.
5. Revocation terms and conditions/Right to revoke
If you are a consumer as per § 13 of the German Civil Code (BGB), i.e. if you order goods from our Golfino online store for purposes that cannot be attributed to your commercial or self-employed professional activities, you shall be entitled to the following statutory right to revoke:

You have the right to revoke your declaration to conclude a contract in written form (e.g. letter, fax, e-mail) within 14 days without stating reasons or, if the goods have been sent to you before the end of the deadline, by returning the goods. The period begins upon receipt of these terms and conditions in writing, but not before the recipient receives the goods and not prior to the fulfilment of our information requirements as per Art. 246 § 2 in conjunction with § 1 sections 1 and 2 of the Introductory Law to the German Civil Code (EGBGB) and our duties as per § 312g section1 of the BGB in conjunction with Art. 246 § 3 of the EGBGB. In order to meet the limit set for the revocation, the consumer must send the revocation or the goods in good time. The revocation or returned goods must be sent to:

Revocation consequences
In the event of a valid revocation of this agreement, each party shall return to the respective other party the services received and transfer any benefits derived (e.g. interest). If you are not able to return to us or transfer the services or benefits received, or if you return them in an inferior condition, you must compensate us for any losses in value. You must only pay compensation for the deteriorated condition of the goods or for the benefits you received if the benefits and deterioration are due to your handling of the goods, which shall be ascertained upon examining the condition they are in when returned. “Examining the condition” of the goods means testing them in the usual way of the shop business. Goods suitable for packaging must be returned to us at our cost and risk. Goods unsuitable for packaging shall be collected from your address. Obligations regarding the reimbursement of payments must be fulfilled within 30 days. The time limit begins for you on the date when you send your revocation or return the goods, and for us upon their receipt.

6. Delivery service/ non-deliverable goods
There are occasional cases when certain goods cannot be delivered immediately after they have been ordered. To ensure that you do not have to wait for all the goods to be shipped together, we would then send you the ordered goods in stock. We would send the remaining goods separately and as soon as we can, at no extra cost to you. The delivery time is approx. 5 working days in Germany from the day you receive our order confirmation.
In the exceptional case that we do not accept an order because one of the goods is no longer available, we shall inform you of this immediately. We shall then reimburse any payments you may already have made in this case.
7. Reservation of title
The goods shall remain our property until they have paid for in full.
8. Warranty
We shall observe the statutory warranty regulations in the event of defective goods. Insofar as we guarantee you a seller’s warranty, the details shall be taken from the terms of the guarantee which is attached to each delivered item. Warranty claims are without prejudice to the legal warranty rights.
9. Payment methods
You can pay the amount due by credit card, PayPal or electronic direct debit.
9.1. Payment by credit card
We accept all the well-known credit cards, such as euro-Master Card, Visa and American Express. For credit card payments, you must inform us of the card number, the credit card security code (CSC) and the card’s date of expiry. When paying by credit card, the amount invoiced will be withdrawn from your credit card account. With Visa und euro-Master Card, you will find the card’s security code (CSC) on the back of the card. It consists of a 3-digit code and follows the 6-digit card number. New security standards sometimes insist upon entering an additional PIN number, which you can get from your bank.
9.2. Payment by PayPal
PayPal is an online payment service from PayPal (Europe) for real-time payment solutions. To use PayPal, you first have to register with the PayPal service and enter your bank and credit card details. Payments via PayPal can then be made by entering your e-mail address and a password. The amount for payment is then charged to your PayPal account.
9.3. Payment by electronic direct debit
After completing your order, you will be forwarded to Saferpay, our payments service provider. You will be asked to enter your name, bank account number and bank code. The amount to be paid is then automatically booked from your account.
10. Copyright
The content of the Golfino online store, including all the texts, graphics, photos, images, illustrations and sounds, is protected by copyright. Similarly, the brands used in the Golfino online store are protected in favour of Golfino AG. It is forbidden to use property protected by copyright without prior written permission of Golfino.
11. Applicable law
German law shall apply to all contracts between the customer and Golfino and to all disputes that arise from or are due to these contracts; the validity of the United Nations Convention on Contracts for the International Sale of Goods (CISG) is hereby excluded. With contracts entered into for purposes that cannot be attributed to the customer’s professional or commercial activities (sales contract with consumers), this choice of law applies only if and insofar as the protection granted is not revoked by non-waivable provisions of law in the state or country in which the consumer has his or her usual residence.
12. Place of jurisdiction
With contracts entered into for purposes that cannot be attributed to the professional or commercial activities of Golfino’s contractual partner (contract with consumers), the place of jurisdiction for all disputes from or in the context of a contract shall be in accordance with the applicable statutory provisions.
For all disputes from or in the context of a contract concluded with an entrepreneur who acts on completion of a legal transaction in the line of duty of his commercial or self-employed professional activity, the exclusive place of jurisdiction is the place of business of Golfino AG.
